These terms govern our working relationship. By hiring Jovel Creative, you agree to these terms. They protect both of us and ensure we're aligned from day one.

Services Offered
Marketing Kit Services
Jovel Creative provides fixed-price marketing kit services for real estate professionals, including:
- Custom promotional flyer design (print-ready PDF and digital formats)
- Social media graphics (square post, vertical story/reel, and banner sizes)
- QR code generation linked to your listing, landing page, or URL
- Lead-capture landing page design and hosting (Standard and Premium kits)
- 30-second AI video invite production (Premium kit)
- Optional add-ons as listed on the Packages page
Kit Process
Every kit order follows this process:
- Request - Submit the kit request form with your listing details and package selection
- Confirmation - I reply by email within a few hours to confirm details and package
- Production - I design and build all kit components
- Delivery - All files delivered by email within the stated turnaround window
- Revisions - One round of revisions included per kit
What's Not Included
Unless specifically agreed upon in writing:
- Professional photography or videography
- Logo or brand identity design
- Copywriting or listing description writing
- Ongoing monthly retainer services (available upon request)
- Changes after the included revision round (billed separately)

Pricing & Payment
Kit Pricing
All kit pricing is fixed and listed publicly at jovelcreative.com/services.html. No custom proposals or hourly billing.
- Base Kit — $89 flat
- Standard Kit — $149 flat
- Premium Kit — $199 flat
- Rush delivery (guaranteed 24-hour turnaround) — +$29
- Additional revision round — $25 each
Payment Terms
- Payment due before delivery — Files are sent after payment is confirmed
- Accepted methods — Venmo, Zelle, or PayPal
- Invoice — Sent by email at confirmation with payment instructions
Cancellations
- Before production begins — Full refund
- After production begins — Payment for work completed applies (pro-rated)
If something isn't right, reach out. I'll work with you to make it right.
Client Responsibilities
What You Provide
To produce your kit on time, please provide:
- Listing address, open house date and time, and key property details
- Photos (MLS, phone, or professional — any quality works)
- Headshot and/or brokerage logo (if applicable)
- Your preferred call-to-action (RSVP, book a tour, claim offer, etc.)
- Any brokerage brand colors or style preferences
Delays in providing details will extend the turnaround window. No photos? I can source stock imagery.
Feedback
You agree to:
- Review delivered files promptly and reply with any revision requests within 5 business days
- Consolidate all feedback into a single reply
Revisions
- All kits include one round of revisions at no extra charge
- Additional revision rounds are $25 each
- Revision requests submitted more than 5 business days after delivery may be treated as a new order
Scope changes (e.g., changing the listing address or switching package type) are billed separately.
Intellectual Property
What You Own
After payment, you own the delivered files and have full rights to use them for your listing or event, including:
- The flyer, social graphics, and any other design files in your kit
- The QR code and associated link
- Any content you provided that was incorporated into the kit
What I Retain
I retain the right to:
- Use anonymized or generalized versions of kit work as sample examples
- Reuse design techniques, templates, and approaches for other clients
Don't want your kit used as an example? Just let me know and I won't.
Third-Party Assets
Some projects may use:
- Google Fonts (open source)
- Open source JavaScript libraries
- Stock photos (properly licensed)
All third-party assets are properly licensed and documented.
Warranties & Guarantees
What I Guarantee
- Deliverables as described — Files match the package you selected
- File formats — Flyers delivered as print-ready PDF; social graphics as web-optimized PNG
- Turnaround — Delivery within the stated window after details are confirmed and payment received
- Landing page hosting — Standard and Premium landing pages stay live for 30 days from delivery
- QR code functionality — QR code will link correctly to your landing page or URL at time of delivery
Limitations
I cannot guarantee:
- Specific marketing results, open house attendance, or lead conversions
- Third-party platform availability (social media, QR scanning services, etc.)
- Results from how you distribute or use the delivered materials
After Delivery
- All delivered files are yours to keep and use for the listed property or event
- Landing pages remain live for 30 days; extension available upon request
- Questions after delivery? Reply to your delivery email and I'll help
Termination
Client Cancellation
You may cancel at any time:
- Before production begins — Full refund
- After production begins — Payment for work completed applies (pro-rated based on progress)
You keep all completed work.
My Right to Decline or Discontinue
I may decline or stop work if:
- Payment is not received within a reasonable time after invoicing
- You request content that is illegal, misleading, or unethical
- Communication is unresponsive for more than 14 days
In these cases, you will receive any completed work and a pro-rated refund for incomplete work.
Limitation of Liability
Maximum Liability
My total liability for any claim is limited to the amount you paid for the project. I am not responsible for:
- Lost profits or business opportunities
- Data loss (you're responsible for backups)
- Third-party service failures
- Hosting or domain issues
- Acts of God, force majeure
Indemnification
You agree to indemnify me from claims arising from:
- Content you provide (copyright infringement, etc.)
- Your use of the website
- Your violation of any laws or regulations
In plain English: You're responsible for your content being legal and properly licensed.
Miscellaneous
Governing Law
These terms are governed by the laws of the State of Maryland. Any disputes will be resolved in Frederick County, Maryland.
Changes to Terms
I may update these terms occasionally. Changes apply to new projects only. Active projects continue under original terms.
Entire Agreement
Your signed proposal plus these Terms of Service constitute the entire agreement. Any changes must be in writing and signed by both parties.
Severability
If any part of these terms is found invalid, the rest remains in effect.
